Terms and Conditions of Sale

Please read these Terms and Conditions carefully before purchasing or using RistoManager software. By purchasing, downloading, or installing the software, you agree to be bound by these terms.

1. General Information

RistoManager is a software product developed and distributed by 8Byte di Stefano Basile, with registered office at Via Gaetano Salvemini, 37, 72026 San Pancrazio Salentino (BR), Italy — VAT: IT02666750746 — Email: [email protected] — Phone: +39 0831 1815236.

2. Acceptance of Terms

By purchasing, downloading, installing, or using RistoManager, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, do not install or use the software.

3. Software License Grant

RistoManager is licensed, not sold. 8Byte grants you a personal, non-transferable, non-exclusive license to use the software on a single computer per license purchased, as specified in your invoice. Each license allows installation on one computer only, as the generated serial number is tied to that specific machine.

The number of concurrent users (workstations) is limited to the number of licenses indicated on your invoice. The customer is responsible for obtaining and maintaining licenses for any operating systems and third-party database software used.

4. License Types

Standard: Up to 3 waiter tablets, annual subscription with email support.
Professional: Unlimited waiter tablets, annual subscription with email support.
Advanced: Unlimited waiter tablets, phone and remote support included.
Turnkey: Preconfigured PC with full software, tips and gratuity management, 24/7 support, and free hardware replacement — monthly fee with 36-month minimum commitment.

5. Orders and Payments

Orders are processed through the RistoManager website. Payment methods include credit/debit card (via Stripe) and PayPal. All prices are listed in EUR or USD as indicated at checkout. Invoices are issued electronically after payment confirmation.

Any discrepancy between the order and the invoice must be reported in writing within 7 days of receipt, or the right to claim is forfeited.

6. Free Trial

RistoManager offers a free 30-day trial of the full software with no feature restrictions. The trial is limited only by a maximum number of entries or a maximum usage time. This allows you to verify that the software meets your expectations before purchasing.

7. Support and Updates

For the first 60 days from the purchase date, support and updates are included in the license fee. After this period, support and updates require a separate maintenance contract as outlined in 8Byte's official price list (contact [email protected]).

New software versions may be provided to users without a maintenance contract at 8Byte's sole discretion, subject to applicable upgrade fees.

8. Limited Warranty

8Byte warrants that for a period of 60 days from the purchase date (extended if covered by a maintenance contract):

• The physical media, if any, is free from defects in materials and workmanship under normal use.
• The software has undergone functionality testing in accordance with 8Byte's quality plans.

Any functional discrepancies must be reported to support, preferably in writing, along with instructions to reproduce the error. 8Byte does not guarantee that the software is error-free but will make commercially reasonable efforts to correct reported and verified errors.

This limited warranty is the sole warranty provided by 8Byte. All implied warranties, including merchantability, satisfactory quality, and fitness for a particular purpose, are excluded to the maximum extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by applicable law, 8Byte, its affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from or related to the use or inability to use the software, even if advised of the possibility of such damages. 8Byte's total liability for direct damages shall be zero.

Nothing in this section limits or excludes liability for death or personal injury caused by negligence, or for fraud, or for any other liability that cannot be excluded under applicable law.

10. Restrictions

You may NOT:

• Reverse engineer, decompile, disassemble, or otherwise reduce the software to a human-perceivable form, except as expressly permitted by applicable law.
• Modify, adapt, translate, rent, lease, lend, or create derivative works based on the software or any part thereof.
• Transfer or assign your rights under this license to any third party without the prior written consent of 8Byte.
• Use the software for any unlawful purpose or in violation of any applicable laws or regulations.

11. Termination

This license is effective until terminated. It terminates immediately and without notice from 8Byte if you fail to comply with any term of this agreement. Upon termination, you must destroy the software, all accompanying written materials, and all copies thereof. Sections 8, 9, 10, 11, 12, and 13 survive termination.

12. Intellectual Property

The software and all associated intellectual property rights are owned by 8Byte di Stefano Basile. The software is protected by copyright laws, international treaty provisions, and all applicable national laws. All trademarks not expressly attributed to 8Byte are the property of their respective owners.

13. Changes to Terms

8Byte reserves the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated revision date. Continued use of the software after changes constitutes acceptance of the new terms.

14. Governing Law

These Terms and Conditions are governed by Italian law. Any disputes arising from or related to this agreement shall be subject to the exclusive jurisdiction of the courts of Brindisi, Italy.
